Acceptance of TermsBy accessing or using services provided by Digital Animal, LLC. ("Digital Animal," "we," "us"), including but not limited to website development, marketing systems, and membership plans (collectively, the "Services"), you agree to comply with these Terms and Conditions ("Terms"). If you do not agree, you may not use the Services.Scope of ServicesService Description:Development of marketing systems using platforms like Go High Level and third-party integrations.Membership-based access to features outlined in the Master Service Agreement (MSA).Hosting via Cloudflare (not including email hosting or unrelated IT services).

Membership Requirements:

Active subscription required for continued access.

Subscription tiers and features are detailed on the Digital Animal website.

User ResponsibilitiesAccount Management:Provide accurate information during registration.Maintain confidentiality of login credentials.Notify us immediately of unauthorized account use.

Content & Conduct:

Ensure all text, images, or data provided to Digital Animal are legally owned or licensed.

Prohibited activities: Spamming, illegal content, reverse engineering, or disrupting Services.

Community forums/blogs: You are solely responsible for publicly shared content.

Payment Terms Fees: Development fees (one-time or recurring) and monthly membership fees as specified in your plan.Payments processed via Stripe; no Billing Information stored on our servers.

Billing Cycle:

Automatic monthly charges unless canceled (see Termination).

Late payments may result in service suspension.

Refunds:

No refunds for partial subscription periods or completed development work.

Intellectual PropertyClient Ownership:You retain rights to text, images, and data provided. Final design deliverables are licensed to you exclusively for project use.

Digital Animal Ownership:

Retains rights to proprietary tools, code, templates, and design frameworks.

Reserves the right to showcase your project in portfolios/case studies (unless otherwise agreed).

Third-Party ServicesIntegration:Services may link to platforms like Facebook, Google Analytics, or LinkedIn. Digital Animal is not responsible for third-party terms, data practices, or outages.

Subprocessors:

Payment processing (Stripe), analytics (Google), and hosting (Cloudflare) partners operate under their own policies.

TerminationBy You:Cancel membership via account dashboard or by contacting [email protected]. Data removal: Account deletion requests processed within 30 days; backups may persist briefly.

By Us:

May terminate for violations of these Terms, non-payment, or legal compliance needs.

Disclaimers & LimitationsService "As Is":No guarantees of error-free operation, uninterrupted access, or compatibility with all devices/browsers.

Liability Cap:

Digital Animal’s liability limited to fees paid in the 12 months preceding a claim.

Excludes indirect damages (lost profits, data loss, etc.).

Legal & ComplianceGoverning Law:Disputes governed by Colorado law; jurisdiction in Colorado courts.

Updates to Terms:

Material changes notified via email or website notice 30 days in advance.

Compliance with Laws:

GDPR/CCPA rights (e.g., data access/deletion) outlined in the Privacy Policy.

MiscellaneousForce Majeure: Not liable for delays due to events beyond our control (e.g., pandemics, natural disasters).Severability: If any clause is invalid, the rest remain enforceable.Entire Agreement: Supersedes prior agreements; amendments require written consent.
